1. About these terms

These Terms & Conditions govern your use of this website and the Spanish tutoring services offered by Michelle Garcia Ramos ("the Tutor"). By creating an account or purchasing lessons you agree to these terms in full. If you do not agree, please do not use the service.

2. Services

The Tutor provides one-on-one online Spanish language lessons delivered via video call. Lesson availability, duration, and format are as described on the booking page. The Tutor reserves the right to adjust the service offering with reasonable notice.

3. Booking

Lessons are scheduled through the integrated Cal.com booking system. A booking is confirmed only after a lesson credit has been successfully deducted from your account balance. You will receive a confirmation email from Cal.com.

4. Cancellation and rescheduling

• Cancel or reschedule from your dashboard, where every booked lesson is listed. This is the only place a lesson can be cancelled; the Cal.com confirmation email will not offer you a cancellation link.
• You may cancel a booked lesson when there are 24 hours or more before its scheduled start time. The credit returns to your balance immediately and can be spent on another lesson, keeping its original expiry date.
• With less than 24 hours' notice a lesson can no longer be cancelled, and a lesson missed at that point — whether you cancel it elsewhere or simply do not attend — uses up its credit. The Tutor has reserved that time and can no longer offer it to anyone else.
• If the Tutor needs to cancel a session, you receive a full credit refund however much notice she is able to give, and will be offered an alternative slot.

5. Payments and credits

• Lessons are purchased as a credit package via Stripe. Credits are added to your account immediately upon successful payment.
• Credits are valid for 90 days from purchase and are personal and non-transferable. Your dashboard shows the expiry date of every credit and warns you when one is within 30 days of expiring.
• If you need more time, ask and we will give it. Credits are dated so that lessons stay regular — language learning does not survive long gaps, and the Tutor reserves teaching time against credits sold. The limit is not there to keep money for lessons you did not receive. If illness, travel, work or anything else stops you using your credits in time, email [email protected] before or shortly after they expire and we will extend them. We will not unreasonably refuse.
• All prices are shown inclusive of any applicable taxes.
• Separately from anything in this section, you have a statutory right to withdraw within 14 days of purchase and be refunded for every credit you have not used. That right is set out in Section 6 and nothing here limits it.

6. Your right of withdrawal

If you are a consumer, you have the right to withdraw from your purchase within 14 calendar days of buying lesson credits, without giving any reason and without penalty (Arts. 102–108 of Spanish Royal Legislative Decree 1/2007).

How to withdraw. Email [email protected] before the 14 days are up and say that you want to withdraw. You may use the model form below, but any clear statement is enough — the form is a convenience, not a condition. We will refund you within 14 days of receiving your notice, to the same payment method you paid with.

What you get back. Refunds are worked out credit by credit:

• Every credit you have not used is refunded in full.
• Any lesson you have already taken is deducted at the price you actually paid for it — that is, the per-credit price of your purchase, not a higher single-lesson rate (Art. 108.3).

So if you buy a pack of four and take one lesson within the 14 days, you are refunded for the other three. You lose the right of withdrawal for a purchase only once every credit in it has been used, because at that point the service has been fully performed (Art. 103.a). Booking a lesson that falls inside the 14 days counts as expressly asking us to begin before the period ends.

A trial lesson is a single credit, so taking it uses up that purchase in full and ends the withdrawal right for it.

7. Age and minors

You must be 18 or over to create an account, buy credits or book a lesson. Accounts are for adults only.

Minors are welcome as students, but the contract is always with an adult. If the lessons are for someone under 18, the parent or legal guardian must be the account holder and the one who purchases and books. By doing so, they confirm that they hold parental authority or legal guardianship over the student, that they accept these terms on the student's behalf, and that they consent to the processing of the student's personal data as described in the Privacy Policy.

The guardian remains responsible for the student's conduct during lessons and for arranging their attendance. If we learn that an account has been opened by someone under 18, we will close it and refund any unused credits.

8. Acceptable use

You agree not to:

• Record sessions without the prior written consent of the Tutor.
• Share, resell, or redistribute any lesson materials provided.
• Use the service for any unlawful purpose.
• Attempt to disrupt or gain unauthorised access to the website or its systems.

9. Intellectual property

All lesson materials, exercises, and content provided by the Tutor remain her intellectual property. You are granted a personal, non-commercial licence to use them solely for your own learning.

10. Limitation of liability

To the maximum extent permitted by law, the Tutor is not liable for any indirect, incidental, or consequential loss arising from your use of this service. The Tutor's total liability for any claim shall not exceed the value of credits currently held in your account.

11. Governing law

These terms are governed by Spanish law. Any disputes shall be subject to the jurisdiction of the courts of Spain, without prejudice to the right of a consumer to bring proceedings in the courts of their own place of residence.

12. Changes to these terms

The Tutor may update these terms from time to time. The "Last updated" date will reflect any changes. Continued use of the service after an update constitutes acceptance of the revised terms.
